Collective Enfranchisement

The collective enfranchisement process can be a minefield and as experts we can lead you through the process.

In brief a group of leaseholders will qualify if:

  • Half of the total number of flats in the building must participate.
  • The non-residential element must not exceed 25%.
  • Lastly there is no residency requirement and there is no two year ownership rule as there is for a lease extension claim.

Please note that the cost of acquiring the freehold increases when the lease drops below 80 years due to the inclusion of marriage value.
